Taobao2SG Terms of Service

 

1. INTRODUCTION

 

1.1 Welcome to the Taobao2SG platform (the "Site"). This Site (Taobao2SG.com) is owned, managed, and operated by AKW Trading & Logistics LLP, a company incorporated in Singapore.  We, hereinafter referred to as "Taobao2SG” or the “Company”, would like to thank you, hereinafter referred to as “you”, “user”, “customer”, “client” or “member”, for visiting our website, mobile site, or mobile app. The "Services" we provide or make available include (a) the Site and its mobile app and platform, (b) the freight forwarding services from China to Singapore, and local delivery services of parcels within Singapore provided by Taobao2SG and its affiliated business company, (c) consultation services regarding import-related regulations, policies, and procedures in Singapore and China, and (d) Singapore and China e-commerce services and (d) all information, linked pages, data, text, images, photographs, graphics, video and audio materials, messages, tags, content, software application services or other materials made available through the Site. Any new features added to, amended from, or augmenting the Services are also subject to these Terms of Service. These Terms of Service govern your use of Service provided by Taobao2SG. Your use of our Site constitutes your full agreement to our Terms of Service, our Privacy Policy, and all other policies, which shall form a legally binding and enforceable contract between you and Taobao2SG.

 

1.2 The Services include an online platform that provides a place, opportunity and communication channel for you to

--   -- (a) engage Taobao2SG to forward your air and/or sea freight from China to Singapore.

--   -- (b) request Taobao2SG to deliver your parcels to your required address in Singapore.

--   -- (c) place shipping orders by using the Site, and

--   -- (d) order other Services provided by Taobao2SG.

 

1.3 Before becoming a User of the Taobao2SG Site, you must read and accept all the terms and conditions in, and linked to, these Terms of Service and you must consent to the processing of your personal data as described in the Privacy Policy linked hereto. 

 

1.4 Taobao2SG reserves the right to change, modify, suspend or discontinue all or any part of this Site or the Services at any time or upon notice as required by laws of Singapore. Taobao2SG may impose limits on certain features or restrict your access to parts of, or the entire, Site or Services in its sole discretion and without notice or liability. 

 

1.5 Taobao2SG reserves the right to refuse to provide you access to the Site or Services or to allow you to open a User Account for any reason.

 

1.6 By using Taobao2SG services or opening an account on our Site, you give your full and irrevocable acceptance of and consent to the Terms of Service, including those additional terms and conditions and policies referenced herein and/or linked hereto. 

 

1.7 If you do not agree to these terms, please do not use our services or access the site. If you are under the age of 18 or the legal age for giving consent hereunder pursuant to the applicable laws in Singapore (the “legal age”), you must get permission from a parent or legal guardian to open an account and that parent or legal guardian must agree to the terms of these Terms of Service. If you do not know whether you have reached the legal age, or do not understand this section, please do not create an account until you have asked your parent or legal guardian for help. If you are the parent or legal guardian of a minor who is creating an account, you must accept the terms of this agreement on the minor's behalf and you will be responsible for all use of the account or company services using such account, whether such account is currently open or created later.

 

2. USER ACCOUNT

 

2.1 To use Taobao2SG’s services, you must register with Taobao2SG by creating an account ("User Account") on the Site. You agree to provide honest, complete, current, valid, and updated information about yourself, including but not limited to your name or legal identity information, contact number, Singapore registered address for delivery, payment details, and other information required by the Singapore Customs for clearance of imported goods. If we have reasonable grounds to suspect that the information and/ or data you have provided is misleading, inaccurate, untrue, invalid, or fraudulent, we reserve the right to suspend and/ or terminate your use of our Services and/or the Site.  

2.2 You shall be responsible for maintaining the confidentiality of the User Account information and activities of your own User Account. You will keep secure and confidential your account password or any identifiable information we provide you which allows you to access the Service and the Site. The sharing of your User Account with other persons may cause irreparable harm to Taobao2SG, and we shall be indemnified against any loss or damages, including but not limited to loss of profits suffered because of the mishandling and/or misuse of your User Account.

2.3 You shall not create multiple User Accounts with the intent to, including but not limited to, abusing our staff, or misusing our Services and/or the Site. Taobao2SG shall not be liable for any loss or damages arising from your failure to comply with these Terms of Service.  We reserve the right to suspend and/or to terminate your use of our Services and/or the Site if we have reasonable grounds to suspect that multiple User Accounts were created to misuse our Service and/or the Site.

2.4 If you select a User ID that Taobao2SG, in its sole discretion, finds offensive or inappropriate, Taobao2SG has the right to suspend or terminate your User Account.

2.5 You may terminate your User Account if you notify Taobao2SG in writing (including email, letter, and text message) of your desire to do so. Notwithstanding any such termination, you remain responsible and liable for any incomplete and/or unpaid transactions (whether commenced prior to or after such account termination).

 

3. PRIVACY POLICY

 

Your privacy is very important to us at Taobao2SG. We have provided the Taobao2SG Privacy Policy to explain our privacy practices in detail to better protect your privacy rights. Please review the Privacy Policy to understand how Taobao2SG collects and uses the information associated with your User Account and/or your use of the Service.

Taobao2SG requires your personal information to be able to provide our Service to you, especially for the following reasons:

• Internal record keeping.

• Use the information to improve our Services including but not limited to accurately receiving parcels on your behalf, delivering the parcel to your registered address, and clearance of imported goods on your behalf at the Singapore Customs.

• We may periodically send promotional news about changes to our Service or special offers that we think you may find useful by using the personal particulars which you have provided us, including but not limited to your e-mail, mobile phone number, and social media identification at WeChat, Telegram, WhatsApp or your other social media accounts.

We will never provide your personal information to third parties or sell your personal information.

We are committed to ensuring that your information is secure. For the protection of your privacy and prevention of unauthorised access to your personal information, we have put in place very secure procedures to safeguard the information we collect from you.

 

3.1 We may collect the personal details you submit on our site, such as name, email, mobile phone number, registered address, etc. We may also collect other personal information that you provide us via e-mail, telephone, live chat sessions, or alternate electronic or paper communication.

3.2 By registering a User Account, using the Service, or providing information on the Site,

(i) you agree that Taobao2SG may collect, hold, use and transfer your personal data in accordance with our Privacy Policy.

 

(ii) you consent to Taobao2SG’s collection, use, and/or processing of your personal data and User Account Information as described in our Privacy Policy.

 

(iii) you agree and acknowledge that the proprietary rights of your User Account Information are jointly owned by you and Taobao2SG.

(iv) you agree that you shall not, whether directly or indirectly, disclose your User Account Information to any third party, or otherwise allow any third party to access or use your User Account information, without Taobao2SG’s prior written consent.

 

3.3 Our website uses cookies to enhance your user experiences. You can choose to accept or decline cookies. Most web browsers automatically accept cookies. You can modify your browser setting to decline cookies if you prefer. However, this may prevent you from taking full advantage of the Site.

 

3.3 Our website may contain links to external sites to enable you to visit other websites of interest. However, we cannot be responsible for the protection of privacy and other personal information which you provide to external sites that are linked to Taobao2SG. You should exercise caution while providing your personal information to any websites outside the Taobao2SG.com site.

3.4 You are welcome to link your own website to Taobao2SG, provided that your website does not imply any endorsement by or association with Taobao2SG.

 

4. TERMS OF USE

 

4.1 By registering a User Account, using the Service, or providing information on the Site, you agree that you will not

 

(a) import any unlawful, contraband, or prohibited goods into Singapore via our sea and/or air shipping services,

(b) import any controlled goods into Singapore unless you have an import permit or authorization from the relevant controlling authority for importation into Singapore,

(c) violate any laws, including without limitation to any laws and regulation in relation to export and import restrictions of Singapore,

(d) provide any incomplete, invalid, untrue, or fraudulent information in the transaction with Taobao2SG,

(e) make any fraudulent declaration regarding the true nature, attributes, properties, and quantities of your imported goods,

(f) make any fraudulent declaration regarding the true values of imported goods to evade payment of GST,

(g) infringe the rights of Taobao2SG, including any intellectual property rights and any passing-off of the same thereof,

(h) compromise the integrity and security of our Site, software, or server systems

(i) use any device, software or routine to interfere or attempt to interfere with the proper working of the Site,

(j) hack into any aspect of the Site,

(k) collect or track the personal information of others or to stalk, harass, or otherwise harm another user of our Site,

(l) verbally or physically abuse our customer service staff under any circumstances

 

4.2 If your parcels cannot be shipped into Singapore due to false declaration and/or the restrictions of law or other regulations, we shall not be held liable, and you shall fully indemnify us for all the costs, penalties, loss, damages, and expenses incurred and/or suffered by us.

4.3 If your parcels cannot be shipped into Singapore or were delayed in shipping to Singapore because of your false declarations regarding values and properties of your imported goods, we shall not be held liable, and you shall fully indemnify us for all the costs, penalties, loss, damages, and expenses incurred and/or suffered by us.

4.4 You agree to assume full responsibility and liability for all loss or damage suffered by yourself, the third-party service provider, Taobao2SG, the Company or any third party because of your breach of the Terms of Service.

 

5. FREIGHT FORWARDING SERVICES

 

5.1 Our forwarding service allows you to forward your parcels from China to Singapore via air shipping or sea shipping. Only after you have made the full payment to us for the shipping fee based on the weight and size of your parcels, we will arrange the shipment of your consolidated parcels to Singapore.

5.2 The forwarding fees are based on the published fee schedule on the Taobao2SG Site.  Any change or update to the existing published shipping fees will be announced and published on the Site.

5.3 We also provide parcel inspection service. You must pay additional processing/inspection fees if such services are to be requested.

5.4 We will be responsible for and liable for parcels that were lost during the shipping process.  Compensation for a lost parcel will be based on its value, which was declared by the client when the client submitted the shipping order.  The maximum compensation value for a lost parcel is S$600. A lost parcel with a declared value higher than S$600 will receive a maximum of S$600 compensation from shipping insurance. 

5.5 We reserve the right to reject your shipping order if we believe that your parcels contain highly fragile, hazardous, or explosive items.

5.6 We will not forward any illegal and prohibited items to Singapore for you.

 

6. COMPENSATION FOR LOST OR DAMAGED ITEMS

 

Taobao2SG will exercise due care, diligence, and skill in supplying you with our shipping services. However, the nature of shipping services is such that circumstances may impact the successful delivery of your parcels.

6.1 We promise to take very good care of your parcels in our warehouses but are not liable for a damaged or a lost parcel which was damaged or lost during the shipping process unless you have purchased shipping insurance for the parcel from us prior to shipping. A reimbursement equivalent to the declared value of your lost or damaged parcel will be compensated to you only if you have purchased shipping insurance for that parcel prior to shipping.

6.2 For a damaged parcel that is not insured, you may claim for standard liability compensation within 7 days from the date that you receive the damaged parcel. The standard liability is equivalent to three times of the paid shipping fee for the damaged parcel, rather than the declared value of the damaged parcel.  The standard liability is capped at S$100. 

6.3 For a lost parcel that is not insured, you may claim for standard liability compensation within 45 days from the date that the parcel was shipped out from the departing port. The standard liability is equivalent to three times the paid shipping fee for the lost parcel or capped at S$100 rather than the declared value of the lost parcel.

 

7. LOCAL DELIVERY SERVICE

 

7.1 We provide parcel delivery service to your registered or requested address for parcels that have arrived in Singapore.  The local delivery fees are published on the Site and subject to future change or update.

7.2 The normal delivery fees that are published on the Site apply only for normal home deliveries to lift-accessible floors and truck-accessible areas. If our delivery staff are unable to deliver your parcel to your place due to legitimate reasons, including but not limited to, bulky parcels that are too large to enter the lift, out-of-service lift upon arrival, walk-up apartments, or houses that do not have a lift, unusual location which has no suitable unloading point nearby, we may opt to manually carry and deliver your parcels to your doorstep. However, additional charges for manual carry and delivery will be required.

7.3 There is no delivery service to remote or restricted areas such as military camps.

 

8. WAREHOUSE STORAGE CHARGES AND DISPOSAL

 

8.1 Storage charges may apply if you let your parcels stay in our warehouse longer than the free storage period published on the Site, which is usually 30 days but is subject to update and change.  The storage fee is published on the Site. 

8.2 In certain circumstances, such as parcels in the warehouse that have not been claimed, self-collected, or requested to be delivered by a User for more than 90 days, we may dispose of the parcels and are not liable to the disposal of the unclaimed parcel.

 

9. ERRORS, INACCURACIES, AND OMISSIONS

 

9.1 Occasionally there may be information on our Site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to descriptions of services, pricing, promotions, offers, shipping charges, and transit time. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on the Site is inaccurate at any time without prior notice (including after you have submitted your shipping order).

 

10. PAYMENT

 

10.1 Taobao2SG accepts the following payment methods in Singapore.

 

(a) PayNow to our company registered UEN or our corporate mobile number.

(b) Fund Transfer via Internet Banking to our OCBC or DBS corporate bank account.

 

The information regarding our UEN and corporate bank account numbers is published on the Site.

 

10.2 We do not accept cash payment and other modes of payment.

 

10.3 By using our Service or the Site, you agree that you will not submit any fraudulent, untrue, incomplete, or invalid proof of payment to deceive or mislead our service staff.  We reserve the right to sue for unfair and/or fraudulent payment by any User. 

 

11. ALIPAY SERVICES

 

11.1 We provide a “Pay-for-You” service to clients who have no bank account in China to pay their sellers on e-commerce sites.  We will pay a client’s purchases in any China e-commerce platform via our Alipay account after the client has made an equivalent full amount of payment in Singapore dollars to us.  

11.2 The exchange rate for this Alipay “Pay-for-You” service is updated daily based on the rate published by Alipay or a discretionary exchange rate that is published on our Site or announced by Taobao2SG.  

11.3 The Alipay “Pay-for-You” service is only available for customers who need us to pay their sellers in China e-commerce sites on their behalf and will not be available for any other purposes. 

 

I have read these Terms of Service and agree to all the terms and conditions contained above and any revision of the same hereafter. By my registration of a User Account at the Site, I understand that I am creating a digital signature, which I intend to have the same force and effect as if I had signed my name manually.
